Terms of Service

Please read these terms carefully before booking your journey.

1. Acceptance of Terms

By booking, registering for, or participating in any trip, tour, or service organized by Barakah Travel & Heritage Tours ("the Company"), you ("the Participant") acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and the Company.

2. Eligibility

Participation in our tours is subject to the following eligibility requirements:

Barakah Travel & Heritage Tours reserves the right to deny participation to any individual who fails to meet these eligibility requirements or provide necessary documentation.

3. Nature of Services

Barakah Travel & Heritage Tours organizes group travel experiences that combine Umrah pilgrimage with Islamic heritage exploration. We act as a tour operator and educational facilitator.

Please be advised that the Company is not an airline, hotel operator, or direct provider of ground transportation. All flights, accommodations, and transport services are provided by independent third-party vendors. While we curate these partners with care, we do not own or operate them.

4. Assumption of Risk

International travel involves inherent risks. By participating, you voluntarily assume all risks associated with travel, including but not limited to:

5. Independent Conduct of Participants

This section is of critical importance. Please read carefully.

Each Participant is solely responsible for their own behavior, actions, and speech. The actions, statements, or misconduct of any individual participant during the trip do not represent Barakah Travel & Heritage Tours, its founders, leadership, scholars, or affiliates.

We facilitate a group environment, but we are not liable for the independent actions or personal conduct of other travelers. You agree to conduct yourself respectfully, with integrity, and in accordance with Islamic manners (Adab) and the laws of the host countries.

The Company reserves the right to remove any participant from the trip, without refund, if their conduct is deemed detrimental to the group, violates local laws, or compromises the safety and dignity of the experience.

7. Payments, Deposits & Refund Policy

Price basis. All prices are quoted per person in US dollars and assume you share a room. Your package tier determines how many travellers share: quad, triple or twin in Makkah and Madinah, and twin share in Spain in every tier. A Private Room option is available at a supplement. Flights, hotels, rail, transfers, guides, entrance fees, most meals and your Umrah visa are included in every tier; the tier changes only your rooming.

Deposit. A deposit of $750 per person is required to secure your place. The deposit is applied to your total package price.

Payment schedule. A second payment of 40% of the remaining balance falls due approximately 120 days before departure. The final balance is due 45 days before departure. Failure to pay by the stated deadline may result in the release of your place, and the cancellation terms below will apply.

Payment methods. Payment by bank transfer is accepted without charge. Payment by card carries a processing fee, which is displayed to you before you complete payment. We never store your card details.

Minimum group size. Each departure requires a minimum number of confirmed travellers, stated on the journey page. If that minimum is not met, we will notify you at least 60 days before departure and you may elect either a full refund of all monies paid to us, or transfer to an alternative departure.

Cancellation by you. Cancellation requests must be made in writing. Your deposit becomes non-refundable on the date your place is committed to airlines and accommodation providers; that date is confirmed to you in writing at the time of booking. After that date, refunds are calculated against the amounts we have irrecoverably committed to third-party suppliers on your behalf, and the applicable schedule is provided to you in writing at the time of booking. Airline tickets, once issued, are governed by the airline's own fare rules and are frequently non-refundable.

Cancellation by us. If we cancel a departure for any reason other than your default, you will be offered a full refund of monies paid to us or a transfer to an alternative departure of equivalent value.

Third-party costs. We are not responsible for flights, accommodation or other arrangements you purchase independently of this package, including any costs arising from a change to our itinerary.

Travel insurance. Travel insurance is not included in the package price and is strongly recommended. We recommend that cover is arranged at the time you pay your deposit, so that it responds to cancellation as well as to events during travel.

Passport and entry requirements. It is your responsibility to hold a passport valid for at least six months beyond your date of return, and to meet all entry requirements for Spain and the Kingdom of Saudi Arabia. We will assist with your Umrah visa application. We cannot refund a traveller who is denied boarding or entry for want of valid documentation.

Administrative fees. A reasonable administrative fee may be applied to cancellations, name changes and refunds, and will be disclosed to you before it is charged.

8. Trip Cancellation & Force Majeure

The Company shall not be liable for failure to perform its obligations if such failure is a result of Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service, or pandemic/epidemic (Force Majeure).

In the event of such circumstances, the Company reserves the right to modify, reschedule, or cancel itineraries as necessary to ensure safety and compliance.

9. Media & Content Release

During the tour, photographs and video footage may be taken by Company staff or hired professionals. By participating, you grant Barakah Travel & Heritage Tours a non-exclusive, royalty-free license to use such media for promotional, educational, and marketing purposes.

If you prefer not to appear in marketing materials, you must notify us in writing prior to your departure date.

10. Health & Fitness

Participants are responsible for ensuring they are medically and physically fit to travel. Our tours often involves moderate walking, specifically during heritage site visits and Umrah rites.

The Company does not provide medical services. We strongly recommend that all Participants purchase comprehensive travel insurance that includes medical coverage and emergency evacuation.

11. Limitation of Liability

To the fullest extent permitted by law, the liability of Barakah Travel & Heritage Tours for any loss, damage, or injury arising from these terms or the tour shall be limited to the total amount paid by the Participant to the Company for the specific trip.

In no event shall the Company be liable for any indirect, incidental, consequential, special, or exemplary damages.

12. Governing Law

These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of Minnesota.

13. Modifications to Terms

Barakah Travel & Heritage Tours reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting to this website. Your continued use of our services or website following the posting of revised terms means that you accept and agree to the changes.
